PAYMENTS

ALL PAYMENTS ARE IN US DOLLARS. ALL ORDERS ARE PAYABLE IN ADVANCE. PAYMENT WILL BE ACCEPTED BY CASH, CASHIER’S CHECK, MASTERCARD, VISA, AMERICAN EXPRESS, COMPANY AND PERSONAL CHECK AND BANK WIRE TRANSFER.  THERE WILL BE A (15) BANKING DAY DELAY IN SHIPPING FOR COMPANY AND PERSONAL CHECKS. THERE IS A $35.00 CHARGE FOR ALL CHECKS THAT ARE RETURNED FOR ANY REASON.

TITLE OF GOODS

WILDLIFE ETC RESERVES THE SECURITY INTEREST IN THE GOODS WHICH ARE SUBJECT OF A SALE. TITLE OF THESE GOODS DOES NOT PASS FROM WILDLIFE ETC TO THE BUYER UNTIL PAYMENT HAS BEEN RECEIVED. ANY PAYMENT BY NEGOTIABLE INSTRUMENT DOES NOT RESULT IN THE PASSAGE OF TITLE OF THE GOODS WHICH IS THE SUBJECT OF A SALE UNTIL THE BUYER’S FINANCIAL INSTITUTION HAS HONORED THE NEGOTIABLE INSTRUMENT.

CHANGES IN PRODUCTS AND PRICING

WILDLIFE ETC USUALLY SHIPS ITEMS WITHIN (5) DAYS OF RECEIVING AN ORDER. ZEBRA RUGS AND OTHER GAME SKIN RUGS THAT NEED TO BE FELT BACKED MAY TAKE LONGER BEFORE SHIPPING. ALL ORDERS PLACED ON THE WILDLIFE ETC WEB SITES ARE SUBJECT TO PRODUCT AVAILABILITY AND WILL BE SHIPPED ACCORDING TO WILDLIFE ETC’S SHIPPING POLICIES.

WILDLIFE ETC DELIVERS ORDERS VIA A 3RD-PARTY CARRIER (UNITED PARCEL SERVICE OR FEDERAL EXPRESS) FOR ORDERS SHIPPED WITHIN THE DOMESTIC UNITED STATES.  ORDERS ARE DELIVERED TO THE ADDRESS THAT THE BUYER PROVIDES TO WILDLIFE ETC NOT TO THE BUYER DIRECTLY.  PLEASE NOTE; UNITED PARCEL SERVICE AND/OR FEDERAL EXPRESS DO NOT PROVIDE A SERVICE THAT DELIVERS A PACKAGE DIRECTLY TO A SPECIFIC PERSON AT THE DELIVERY LOCATION THUS WILDLIFE ETC IS UNABLE TO PROVIDE SUCH A SERVICE.  BY PLACING AN ORDER WITH WILDLIFE ETC BUYER AGREES THAT BUYER WILL NOT REQUIRE DELIVERY TO THEMSELVES OR TO A SPECIFIC PERSON DIRECTLY.

WILDLIFE ETC REQUIRES A SIGNATURE AT THE DELIVERY ADDRESS PROVIDED TO WILDLIFE ETC BY THE BUYER.  BY PLACING AN ORDER WITH WILDLIFE ETC BUYER AGREES THAT THERE WILL BE AN ADULT PERSON AVAILABLE TO SIGN FOR THE ORDER UPON DELIVERY.  BUYER AGREES TO PAY ANY ADDITIONAL CHARGES FOR AN ADDRESS CORRECTION AND/OR RE-SHIPPING CHARGES INCURRED BY WILDLIFE ETC IF THE BUYER OR BUYER’S REPRESENTATIVE IS NOT AVAILABLE AT TIME OF DELIVERY.

LIMITATION OF LIABILITY

IN NO EVENT SHALL WE OR OUR SUPPLIERS HAVE ANY OBLIGATIONS OR LIABILITIES TO YOU OR ANY OTHER PERSON FOR LOSS OF PROFITS, FOR LOSS OF BUSINESS OR USE, OR FOR INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCTS LIABILITY, OR ANY OTHER THEORY OR FORM OF ACTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF, ARISING OUT OF OR IN CONNECTION WITH THE SALE, DELIVERY, OR USE OF THE PRODUCTS.  OUR SOLE AND ENTIRE MAXIMUM LIABILITY (AND THE LIABILITY OF OUR SUPPLIERS) FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS YOU HAVE ORDERED THROUGH OUR WEBSITE. REFUND/RETURN POLICY

FOR ORDERS NOT MADE IN PERSON OR BY BUYER’S REPRESENTATIVE/AGENT, SPECIAL ORDERS OR AUCTION ITEM(S), REFUNDS (LESS S/H) WILL BE MADE AND RETURNS WILL BE ACCEPTED WITHIN 10-DAYS OF THE “SHIP DATE” OF THE ITEM(S). ITEM(S) MUST BE RETURNED IN THEIR ORIGINAL CONDITION. ALL ITEMS MUST BE RETURNED IN THE SAME MANNER, IN WHICH THEY WERE ORIGINALLY SHIPPED, (BOX, PACKING MATERIAL, CARRIER, ETC.), WITH NO EXCEPTIONS. PLEASE CONTACT WILDLIFE ETC FOR A RETURN AUTHORIZATION NUMBER. ANY RETURN ITEM IS SUBJECT TO A RESTOCKING CHARGE OF 5 TO 15% OF THE PURCHASE PRICE. ANIMAL SKIN REPAIR & FELT BACKING SERVICE

PLEASE NOTE, THESE SERVICES ARE OFFERED TO THE CUSTOMER AT THE SOLE RISK TO THE CUSTOMER. THERE IS A POSSIBILITY THAT SOME OF THE PROCEDURES NECESSARY IN LINING/BACKING A SKIN MAY DAMAGE SAID SKIN. ALTHOUGH WE TAKE GREAT CARE IN OUR WORK TO PRESERVE THE INTEGRITY OF A CUSTOMER’S SKIN UNFORESEEN CONDITIONS MAY EXIST THAT WOULD DICTATE THE ACTUAL THE OUTCOME OF THE WORK TO BE PERFORMED. WHILE OUR KNOWLEDGE BASE MAY REDUCE THE RISK OF DAMAGING YOUR SKIN; WE CANNOT ELIMINATE IT, NOR CAN WE ASSUME IT. WHATEVER THE CASE MAY BE; THE CUSTOMER BY CONTRACTING WILDLIFE ETC TO PERFORM THESE SERVICES AGREES TO HOLD WILDLIFE ETC AND ANY OF WILDLIFE ETC’S SUBCONTRACTORS FREE OF LIABILITY.

FURTHERMORE, ONCE THE RUG HAS BEEN RECEIVED BY THE CUSTOMER THERE IS NO EXTENDED WARRANTY FOR THE WORK THAT WAS PERFORMED BY WILDLIFE ETC  ALL WORK IS “AS IS, WHERE IS, NO WARRANTY IS EITHER EXPRESSED OR IMPLIED.” CUSTOMER IS RESPONSIBLE FOR ALL SHIPPING AND HANDLING CHARGES FOR DELIVERY OF THE RUG/SKIN THAT WILDLIFE ETC IS TO PERFORM THE WORK ON TO WILDLIFE ETC  CUSTOMER IS RESPONSIBLE FOR ALL SHIPPING AND HANDLING CHARGES INCURRED BY WILDLIFE ETC TO RETURN THE FINISHED RUG/SKIN TO THE CUSTOMER.  IN THE UNLIKELY EVENT THAT WILDLIFE ETC IS UNABLE TO PERFORM WORK ON A RUG/SKIN FOR WHATEVER REASON OR THE RUG/SKIN IS DAMAGED IN THE BACKING PROCESS CUSTOMER IS RESPONSIBLE FOR ALL SHIPPING AND HANDLING CHARGES INCURRED BY WILDLIFE ETC TO RETURN THE RUG/SKIN TO CUSTOMER.
PAYMENT OF FEES FOR ANY FELT BACKING SERVICES IS TO BE MADE PRIOR TO ANY WORK BEING STARTED BY WILDLIFE ETC IN THE EVENT THERE IS AN UNPAID BALANCE INCLUDING SHIPPING AND HANDLING CHARGES THIS AMOUNT SHALL BE DUE AND PAID BEFORE THE RUG/SKIN IS RETURNED TO CUSTOMER.  FUNDS PAID TO WILDLIFE ETC ARE NONREFUNDABLE WHETHER THE WORK PERFORMED IS SUCCESSFUL OR NOT.

DO NOT SHIP YOUR RUG TO US WITHOUT CONTACTING US FIRST.

APPLICABLE LAW

THIS AGREEMENT REPRESENTS THE COMPLETE AGREEMENT BETWEEN THE PARTIES AND SUPERSEDES ALL PRIOR AGREEMENTS AND REPRESENTATIONS BETWEEN THEM. IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE UNENFORCEABLE FOR ANY REASON, SUCH PROVISION SHALL BE REFORMED ONLY TO THE EXTENT NECESSARY TO MAKE IT ENFORCEABLE AND THE OTHER TERMS OF THIS AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT. THE FAILURE OF WILDLIFE ETC TO ACT WITH RESPECT TO A BREACH OF THIS AGREEMENT BY YOU OR OTHERS DOES NOT CONSTITUTE A WAIVER AND SHALL NOT LIMIT WILDLIFE ETC’S RIGHTS WITH RESPECT TO SUCH BREACH OR ANY SUBSEQUENT BREACHES. THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED UNDER TEXAS LAW AS SUCH LAW APPLIES TO AGREEMENTS BETWEEN TEXAS RESIDENTS ENTERED INTO AND TO BE PERFORMED WITHIN TEXAS. ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THESE SITES MUST BE BROUGHT IN THE STATE OR FEDERAL COURTS OF TEXAS.

ONCE AGAIN, THESE TERMS AND CONDITIONS CONSTITUTE THE ENTIRE AGREEMENT AND UNDERSTANDING BETWEEN US CONCERNING THE SUBJECT MATTER HEREOF.  THESE TERMS AND CONDITIONS MAY NOT BE ALTERED, SUPPLEMENTED, OR AMENDED BY THE USE OF ANY OTHER DOCUMENTS.  THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO THE CONFLICTS OF LAWS PRINCIPLES THEREOF, WILL APPLY TO ALL MATTERS RELATING TO THE USE OF THIS WEBSITE AND THE PURCHASE OF PRODUCTS.  EACH OF US AGREES AND HEREBY SUBMITS TO THE EXCLUSIVE PERSONAL JURISDICTION AND VENUE OF THE STATE AND FEDERAL COURTS OF TEXAS.
